This IQ Engines Privacy Policy ("Policy") describes how IQ Engines, Inc. ("IQ Engines," "we," and "our") collects, stores, and handles information when you use IQ Engines' websites (e.g., www.iqengines.com and www.omoby.com) (collectively, the "Website"), the oMoby mobile application and other applications available at the Website, IQ Engines' Image Labeling Service provided on the Website, and other content and services provided on the Website (collectively, the Websites, Image Labeling Service, and such other content and services the "Products and Services"), as well as the steps we take to safeguard your privacy. This Policy governs images and other information submitted to the IQ Engines Image Labeling Service, whether submitted at our website, through one of our device applications, or through a device application published by a third party.
This Policy is incorporated into and deemed part of the IQ Engines Terms of Service ("TOS") that you agree to when using Products and Services. By using the Products and Services you consent to the terms specified in this Policy and to the processing of information in accordance with this Policy. Such information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of information may be less stringent than the laws in your country.
Personally Identifying Information Defined
Personally identifying information is information that specifically identifies an individual or allows someone to contact the individual, such as an individual's name, address, telephone number, and e-mail address, and PayPal, credit card or other account numbers.
Personally Identifying Information Collected
We may obtain personally identifying information about you in various ways. Here are some ways we may obtain personally identifying information about you.
- We may collect certain personally identifying information in connection with your participation in any survey, contest, games, or sweepstakes on any of our Websites.
- We may collect certain personally identifying information when you register an account with us through a website or application, for example we may ask you to enter an email address that will be stored as part of your login information.
- We may collect certain personally identifying information when you contact us by email for any reason, such as to request help with the Products and Services, or to provide us with your comments or feedback, or to provide us with your resume
Non-Personally Identifying Information Collected
Like all website and web service operators, we obtain and use information that is not personally identifying. For example, when you use the Products and Services we may collect information that your browser makes available whenever you visit a website. We may automatically record information received from our server logs that we collect from your browser. This log information includes your Internet Protocol address, browser type, browser language, the date and time of your query and one or more cookies that may uniquely identify your browser. Cookies are small files that are stored on your computer by your browser at the request of a web site to store your personal preferences. We may place recorded information on the Products and Services. This may include your IP address, browser type, the referring domain, pages visited, and search terms. Other actions, such as interactions with advertisements, and purchases may also be included in conjunction with cookies to monitor how visitors are navigating and interacting with the Products and Services.
Minor's Use of our Applications and Services
The Products and Services are not directed to people under 13 years of age. We do not knowingly collect personally identifying information from children under 13 years of age.
How Personally Identifying Information is Used
We use personally identifying information in a number of ways. For example, in the event you have forgotten your password or username, to send you information regarding updates of the Products and Services, potential technical problems, or newly launched features, to process your transactions, to provide support for the Products and Services, to communicate with you about your use of the Products and Services, to respond to user requests and inquiries, to maintain a record of our dealings with users, to improve our Products and Services and to develop new products and services, to solicit your feedback, and to inform users about products or services we think will be of interest (including to send you promotional materials via email and postal mail). We may also receive information, including personally identifying information, from third parties with whom we have business relationships ("Business Partners"), as described in greater detail below, and may combine this information with the other information about you. If we do so, this Policy governs such information. You hereby consent to our Business Partners' provision of your information to us as described in this Policy.
Important Note
We use computer vision and a crowdsourcing service to label your submitted images. In some cases, your images may be viewed by those human resources performing the image labeling function. Your submitted images may also be exposed to IQ Engines company personnel. Please do not submit images that contain sensitive, classified, or personally identifying information (such as driver's licenses, credit cards, utility bills) if you do not want such images to be viewed by people such as our company personnel and public human crowd source image labelers.
Personal Contact Information Shared with Third Parties
We do not sell to any third party your email address, mailing address, telephone number, or credit card information or other account information that we obtain from you during registration or commercial transactions with us without your prior consent, except in the limited circumstances described below. We may share such personal contact information with third-party vendors who assist us in performing internal functions necessary to operate our business. These functions may include, for example, analyzing traffic information or other data, providing marketing assistance, mailing items, processing credit card transactions, and fulfilling or delivering orders. We may also share such personal contact information with Business Partners (as discussed in more detail below).
We may be required by law to disclose your personal contact information in response to subpoenas, court orders, legal process, or other valid law enforcement measures; to comply with a legal obligation; at the request of governmental authorities conducting an investigation; to verify or enforce compliance with the policies governing the Website and applicable laws; or to protect the legal rights, interests, or safety of the IQ Engines, our users or others. We may also use IP addresses to identify users, and may do so in cooperation with copyright owners, Internet service providers, or law enforcement agencies at our discretion. These situations could be legal processes or court orders to establish or exercise our own legal rights and also to defend legal claims. In the case of any actual or suspected illegal activities including, without limitation, threats towards a person's safety, fraud, or violations of this Policy, it may be necessary to share personal contact information with legal authorities. Such information disclosures may be carried out without notice to you.
Personal contact information may also be shared or transferred if IQ Engines is, or all or substantially all of its assets are, acquired by or merges with another company. IQ Engines will inform you by either email or through the Website if this situation occurs. Such other company will possess the information collected by it and us and will assume the rights and obligations described in this Policy. Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control we may in the future. We may share some or all of the information we collect with one or more of these affiliates, in which case we will require each such affiliate to honor our obligations under this Policy.

Links from the Products and Services or image query results to other sites or content are provided for your convenience only and we do not have control over the content, privacy, or security practices and policies of such third parties or other sites. Any information you provide on linked pages is provided directly to that third party and is subject to that third party's privacy policy. We encourage you to learn about third party privacy and security practices and policies before providing personal information.
Business Partners
When you submit information, including personally identifying information, to a Business Partner's site (such as to purchase products from such other site) you will be submitting such information to the Business Partner. The Business Partner may share such information with us and we may share information we collected through our Website with the Business Partner. Information you submit to our Business Partner may be subject to such Business Partner's privacy policy and practices which may differ from this Policy. We do not have control over the privacy practices of the Business Partner's sites. We encourage you to read the privacy policies of Business Partners.
API Integrations – Third Party Applications
When you use a software application published by someone other that IQ Engines, your personally identifying information may be disclosed to such third party and such information will be subject to the privacy policy and practices of such third party. We are not responsible for the privacy policies and practices of any third party and, therefore, you should review the privacy policies and practices of such party prior to using their products or services.
Security
IQ Engines has put into place reasonable security measures in an effort to prevent loss, misuse, and alteration of information while it is under our control. However, IQ Engines cannot guarantee the protection of information against interception, misappropriation, misuse, alteration, or malfeasance, nor can we promise that your information will be not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. Furthermore, we have no control over the security of other sites you might visit, interact with, or do business with, including the Business Partners previously described.
When you register for an account through the Website, we ask you to create a "username" and password. You must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Products and Services by any person using your password. Please advise us immediately if you believe your password has been misused or otherwise misappropriated end an email to: privacy@iqengines.com.
Changing and Deleting your Information
Please note that images that have been identified and labeled by either the Products and Services or yourself may be deleted from your "history" page but may remain part of our image database. Such derivative images, consisting of the image and the unique label, may be used in any commercial manner by IQ Engines in accordance with this Policy. See the TOS for more information.
Opting Out of Communications
To opt-out of receiving marketing or promotional communications from us, or to delete your personal contact information maintained by us, we provide you with the following options: you may (1) follow the "Unsubscribe" instructions contained in the communication from us; or (2) send an email to: privacy@iqengines.com. Despite your indicated e-mail preferences, we may send you service notices, including any updates to our TOS or this Policy.
Policy Changes
IQ Engines reserves the right to modify this Policy in accordance with modification provisions of the TOS. We encourage you to review this Policy each time you visit our Website to see if it has been updated since your last visit, and to ensure that you understand how information you provide will be used.
